Terms of sale

General

By placing an order, you make an offer to purchase goods subject to these Terms. We may refuse or cancel an order where reasonably necessary, including for pricing or listing errors, stock availability issues, suspected fraud or abuse, or supplier allocation issues. If payment has already been received for an order we cannot fulfil, we will arrange an appropriate refund.

Pricing and availability

We aim to keep prices, descriptions and availability accurate, but errors can occur. If a material pricing error is identified before fulfilment, we may ask you to reconfirm at the correct price or cancel the affected item and refund any amount paid. Prices are shown in Australian dollars and include GST where applicable. Shipping charges are shown separately where applicable.

Payment

Our current checkout payment method is bank transfer. Please use your Order ID as the payment reference. Orders are processed after cleared funds are received. You are responsible for any transfer fees charged by your bank.

Discount codes

Promotional or discount codes may be subject to specific conditions. We may refuse or cancel orders where a code has been used improperly, fraudulently or outside its stated conditions.

Gift cards

If PokeNexa offers gift cards, any expiry period and redemption conditions will be stated when the gift card is issued and will comply with applicable Australian law. Gift cards are not redeemable for cash except where required by law.

Refunds and returns

Refunds, returns and exchanges are described in our Refund and Returns Policy. Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.

Pre-orders

Pre-order products are subject to supplier allocation, release dates and availability. Supplier allocations may be reduced, delayed or cancelled. Where necessary we may partially fulfil, delay or cancel affected items and provide an appropriate refund for any unfulfilled paid amount.

TCG product disclaimer

Trading card and sealed products may contain random contents. We do not guarantee specific pull rates, card rarities, grading outcomes or future market value. Manufacturer packaging, print quality and contents can vary. This does not limit any consumer guarantee that applies to the product itself.

Card condition disclaimer

For single cards and condition-sensitive collectibles, condition descriptions are based on our reasonable assessment and may differ from the standards used by individual collectors or professional grading companies. Where a specific condition is stated in the listing, it forms part of the product description.

Grading and third-party services

If we facilitate grading or another third-party service, we act as an intermediary only. Decisions, grades and service timeframes are controlled by the relevant third party. We are not responsible for a third party’s grading outcome or decision, subject always to rights that cannot lawfully be excluded.

Order limits and anti-abuse

We may impose reasonable purchase limits, refuse service, or cancel orders where we reasonably suspect automated purchasing, fraud, abuse, manipulation of promotions, or other conduct that threatens fair access or store security.

Disclaimer of liability

To the maximum extent permitted by law, PokeNexa is not liable for indirect or consequential loss arising from use of the website or products where that liability can lawfully be excluded. Nothing in these Terms excludes or limits liability that cannot legally be excluded.

Third-party links

Our website may contain links to third-party websites. We are not responsible for their content, availability or practices.

Indemnity

To the extent permitted by law, you agree to indemnify PokeNexa against losses arising from your unlawful misuse of the website or material breach of these Terms.
